ATTESTATION OF SUPPLY/PURCHASE
(Hereafter referred to as the Seller and Buyer)
We, the Seller/Buyer, with full corporate authority do hereby warrant and attest, under penalty of perjury, and assuming any and all financial and/or legal liabilities that may arise from any misrepresentations and being subject to any and all relevant applicable damages state unequivocally with complete security that we are ready willing and able to sell ****0 tons per month of RB3 coal to Richards Bay general port terminal. The product is sold FOB Richards bay at *9.*0 USD including 2 USD commissions that will be paid for by the Seller.
We further warrant and attest that this allocation / volumes has been fully confirmed as existing, is true and valid and is available for this Sale & Purchase transaction. We further warrant and attest under penalty of perjury that the Seller has full and complete legal rights and authority to commit and sell this allocation to Buyer and the Buyer has the relevant funds to purchase the product offered subject to the terms and conditions of the contract and this attestation.
The Seller/buyer hereby makes this solemn declaration with complete assumption of any and all fiduciary duties as well as any and all liabilities, and/or fees the Seller would be responsible for, should it be determined that such a liability is the result from any falsities and/or misrepresentations, knowingly made on our party or by our representatives.
This document is only valid for *0 calendar days from signature of this attestation by the seller/buyer. On Buyers written acceptance proof of funds must be provided to seller. Thereafter all other terms and conditions of contract will be adhered to
CONFIDENTIALITY
Undersigned parties hereby agree to the South African Chamber of Commerce provision of non-circumvention and non-disclosure working agreement & IMFPA, or as stipulated in the contractual agreement terms, with regards to all parties involved in this transaction, additions, renewals, and third party assignments with full reciprocation for the full duration until termination from the execution of this transaction.
